LEGAL COLLECTION SERVICES

Should all traditional collection efforts be exhausted and attempts to negotiate a voluntary payment have been exhausted, accounts will be reviewed to determine if legal activities may be warranted. Legal intervention is only utilized when all other methods to secure a voluntary payment have been ineffective and the account balance will only be collected as an outcome of litigation/judgment.

 

Account criteria are established jointly with our clients. The expense involved to litigate, coupled with the anticipated post-judgment remedies available by state are considered to determine if a business case can be established to warrant legal intervention. Typically, the account balance, location of the debtor, court costs and identification of attachable assets are used to make this determination. Receivable Collection Services, LLC maintains an extensive National Attorney Network and has the capability to bring suit in all 50 states.

 

Post Judgment Asset Discovery: Once a judgment has been entered, Receivable Collection Services, LLC will work closely with the attorney’s office to identify attachable assets to liquidate the balance. Our focus is on the identification of a place of employment, whereas an income execution may be placed against, and/or a Bank account whereas a restraining order may be placed to seize the asset. Real property will be identified and a lien placed against the asset, however Receivable Collection Services, LLC  will not initiate foreclosure proceedings unless otherwise instructed to do so by our client.

All protocols and activities are conducted in accordance with the FDCPA, HIPAA, TCPA, FCRA and all other regulatory policies governing the collection of consumer accounts.
